On September 24, the CFTC updated its staff FAQs to clarify how regulated firms can use tokenized versions of permitted assets and blockchain/DLT for recordkeeping under existing requirements.

🔹 Tokenized assets can potentially be used when they provide legal & economic rights equivalent to the underlying permitted asset.
🔹 Blockchain-based records can satisfy certain recordkeeping requirements if they remain reliable, accessible and producible, with appropriate backup controls.

The timing is notable.
Just 9 days earlier, the Senate failed to advance the Digital Asset Market Clarity Act (H.R. 3633) in a 49–50 procedural vote. This was a vote to invoke cloture and move forward—not a final vote to enact the bill.

Congressional legislation would provide a broader statutory framework. But regulatory guidance can still give financial institutions practical clarity today, potentially making tokenized Treasuries, funds and other real-world assets easier to integrate into regulated markets.
