Larger โ Not Just Nevada
The Nevada case is just one of an increasing number of state cases arguing that platforms like Kalshi and Polymarket are illegal operations that evade state gambling laws.
Nevada had previously banned Coinbase and Polymarket on similar grounds.
Arizona is even more aggressive โ Arizona AG has filed 20 criminal charges against Kalshi for allegedly running an illegal gambling business.
In response to Arizona, CFTC Chairman Mike Selig publicly defended Kalshi, calling the criminal charges "inappropriate" and "purely a jurisdictional dispute."
On March 23, 2026, Senators Adam Schiff and John Curtin announced a bill that would (1) prohibit CFTC regulatory entities from offering sports-based contracts, and (2) ban "casino-style games" on prediction market platforms.
Strategic Implications
Kalshi's Business; Loss of market access in Nevada + Arizona, reputation at risk
Regulation: Dangerous precedent โ other states could follow Nevada
Industry: Polymarket, Coinbase also banned โ entire prediction market sector at risk
Federal vs State: The jurisdictional battle between CFTC and state gaming boards is not over
