$BTC CLARITY Act stuck; SEC is directly preparing to move forward with the rules!
SEC Chairman Paul Atkins has clearly stated the latest position.
“Without the CLARITY Act, we will still push for regulatory clarity.”
With Congress’s path blocked, the baton for regulatory follow-through starts to shift toward the SEC!
U.S. Crypto rules won’t stop just because a vote fails once!
The Senate previously failed to get the CLARITY Act past the 60-vote procedural threshold, and continuing to advance the bill in the short term faces difficulties. At the same time, Atkins said that even without this bill, the SEC will continue to promote a crypto regulatory framework, focusing on token issuance, custody, and related market infrastructure rules.
This means the next regulatory main thread may shift from the “Congressional legislation” track to administrative rulemaking by the SEC and the CFTC. However, the two paths are not exactly the same: regulators can refine existing rules more quickly through administrative action, but congressional legislation usually provides a more stable legal foundation that’s also harder to have reshaped by the next administration.
The CLARITY Act hasn’t cleared the hurdle for now, and the rulemaking track continues.
What’s truly worth watching next is which area the SEC will move to implement first!
