A federal judge in California has rejected a motion by OpenAI and Microsoft to dismiss the multi-billion dollar lawsuit filed by Elon Musk. The case is now scheduled for a jury trial in April.
Central to the dispute is Musk's claim for $134 billion in "unjust enrichment." His legal team, supported by financial economist C. Paul Wazzan, estimates OpenAI’s share at $65.5-$109.4 billion and Microsoft's at $13.3-$25.1 billion. Musk, who co-founded OpenAI in 2015 and provided roughly $38 million (60% of early seed funding), contends his contributions—including funding, reputation, and strategic connections—were foundational. "Without Musk, there would be no OpenAI," his filing asserts, arguing he is entitled to a proportional share of the firm's current estimated $500 billion valuation.
